Time Frames between Bankruptcy Discharge Eligibility

We file Chapter 7 and Chapter 13 bankruptcy cases for individuals and the timing for each of these Chapters differs. A basic breakdown of the time frames between discharge eligibility is as follows:

There must be eight (8) years between two Chapter 7 filings in order to be eligible for a discharge.

There must be two (2) years between two Chapter 13 filings in order to be eligible for a discharge.

There must be four (4) years between a Chapter 7 filing and subsequent Chapter 13 filing in order to be eligible for a discharge.

There must be six (6) years between a Chapter 13 filing and subsequent Chapter 7 filing (if the Chapter 13 filing was a Chapter 13 plan paying unsecured creditors less than 70 percent) in order to be eligible for a discharge.
