Beware of the Arrest Scam

Many people believe that they can be arrested for not paying a debt, but often this is a scare tactic employed by debt collectors and scam artists to try and frighten you into making payments you can’t afford. Unless you purposely wrote a bad check and the creditor filed criminal charges for check fraud, you are not going to be arrested just because you owe a normal creditor. (You can, of course, be arrested for not paying child support or taxes.)

Recently some consumers have received an e-mail with “Arrest Warrant” as the subject line and a threatening message telling them to call and make settlement arrangements or they’ll receive jail time. There is even an attachment with a fake arrest warrant. This false threat violates the law and should be reported. Other people have gotten phone calls from debt collectors claiming that they can be arrested if they don’t make a payment today. Don’t fall victim to these scams!

If you are receiving harassing phone calls, e-mails and letters from debt collectors and you haven’t spoken with a bankruptcy attorney yet, now is the time. If you have filed for bankruptcy and you receive this type of communication, it is almost always a scam. Be sure to talk to your attorney first before paying a debt outside your bankruptcy.
